This is a checklist to help you determine if you have a claim against your employer for failure to provide rest periods and meal periods.

1. Did your employer fail to provide a rest period of at least 10 minutes for each 4 hours of work ?

OR Did your employer fail to provide a meal break after every five hours of work?

2. If you were provided meal breaks, where the meal breaks uninterrupted?

3. If you were provided a meal break was the meal break at least 30 minutes long ?

4. Do you have proof whether written calendars, notebooks, or testimony from witnesses proving you were not provided rest periods or meal breaks ?

5. If you were not provided meal breaks or rest periods were you paid an extra hour per each day they were not provided ?

If you answered all the above no, you probably have a good case and should contact an attorney.
