Non-Payment Of Wages

The right to wages is non-waivable and releases are not valid. Hourly employees have to be paid at least semi monthly. Farm labor contractor employees have to be paid at least once a week. Upon termination of employment employees must be paid or the employer would be subjected to penalties for each day the wages are not paid up to 30 days. If the employee leaves voluntarily wages are due within 72 hours. If the employee files suit to recover wages due, the employer may have to pay attorney fees for the attorney hired by the employee. The immigration status of the employee cannot be used as defense.

There are some exceptions as to the time of payment of wages for professionals and non-hourly workers.
