    San Diego Personal Injury Claim

    Several years ago a business man was involved in a serious injury car accident. About six months later he attempted to resolve the case himself. With all his experience negotiating large business transactions he believed he was very qualified to handle the personal injury claim himself. In an attempt to resolve the claim he made dozens of calls and sent out emails, faxes, and letters. From time to time he would get a call back or a letter from the insurance adjuster asking for more information. Eventually the insurance carrier denied his claim on the grounds that the statue of limitations had run out. He then called me, fortunately there were new changes in the law and we were able to pursue his personal injury claim.     Wrongful Death Claims

    You can make a wronggful death claim when someone does something wrong intetionally or through carelessness that leds to death. Negligence is the term used to described someone's mistake, either an error in judgment. This can include claiming expertise, such as ability to electrical work that may cause electrocution or a fire which causes death. It could mean serving a minor alcohol which in turn causes another's death. It makes no difference if the person tried his best or even if the individual render the service for free. There are situations when the individual is in a special relationship to control things and prevent death or injury, such as a bus driver failing to stop an argument which may in turn lead to fight and death. The heirs of the deceased are entitled to make a wrongful death claim, typically the claimants are entitled to make a claim based on the inheritance rules. A completely unretaed individual may be entitled to make a claim if the individual was economically dependent on the deceased.
